Divorce Legal Advice

Even after the final divorce order is issued, many former spouses wind up renegotiating certain aspects of their agreements due to changing circumstances, or initiating actions for post-judgment enforcement, in cases in which their former partner is not abiding by court orders.

Some common types of issues that come up after a divorce is final are addressed below.

Changes to Permanent Orders

Changes to Permanent Orders are a broad category describing any changes made to agreements reached during a divorce. This might include things like changes in spousal maintenance (alimony) payments, changes to child support payments, parenting time, or custody and visitation orders, or any other change made necessary by a change in circumstances after the divorce is finalized.

See the following pages for more information about changes to permanent orders:

Relocation

In cases in which the divorced couple has children, a frequent issue that arises is Relocation. If a custodial parent wants to relocate, he or she must apply for permission of the court to do so, and will usually have to renegotiate visitation schedules with the non-custodial parent before any request is approved.

For detailed information about relocation, see the following pages:

Post Judgment Enforcement

In many divorce cases, one or both parties fail to meet their obligations according to divorce orders. This may mean that a parent is not making spousal maintenance (alimony) or child support payments, is withholding parenting time or visitation, that one parent has relocated without permission from the court, or is withholding property.

In such cases, the other party in the divorce is often forced to take their former partner back to court for post-judgment enforcement action.
