Spousal maintenance, frequently referred to as alimony, is a type of payment ordered one spouse to pay the other, following the dissolution of a marriage.

While there is no clear formula for determining spousal maintenance, some of the factors the court might take into account include:

  • The income and net worth of each party
  • The monetary needs of each party
  • The length of time the parties were married
  • Business valuations, which can predict income for each party
  • The age and health of each party
  • The feasibility of employment for each party
  • Business valuations, which can predict the earning capabilities of each party
  • Whether either party's earning capacity was impeded due to serving a support role for the other party, such as in the case of a stay-at-home parent
  • Whether either party delayed or otherwise impeded their own education, experience, or job training in order to support the other party in their own career or education

Spousal maintenance or alimony may be either temporary or permanent, depending on the specific situation. The amount of maintenance awarded can vary a great deal depending on these factors as well.

If a couple has been married for a particularly long time, and one party has played a support role to the other party, it is likely that the court will order a longer maintenance period than in situations in which both parties were employed, or in which the couple was married only a short time.
