In Michigan, child support orders are calculated using a specific formula for child support help, outlined by the state. This formula takes into account a number of factors, including:
- The parenting time each party spends with the child
- Each parent's net income, including salary, bonuses, tips, and other income
- The number of children in each parent's home
- Health care, childcare, and other expenses
Due to the number of individual factors that are taken into account, the child support guidelines are complex, and it can be difficult to work out on your own what either parent's obligations might be.
While the child support help may make the ultimate order more predictable, the court determines the amount and conditions of the child support order.
The child support order will be issued by the court as a part of the divorce or custody proceedings, or as a discrete action in some cases. Because child support is not intended to enrich one parent over another, the actual support request is entered by a designated Friend of the Court, acting solely in the interests of the child. This means that if a child support order is paid to the child's other parent, the parent receiving the payments cannot voluntarily refuse the payment or request the payments be stopped.
