Divorce Lawyer FAQ
Serving Detroit, Ann Arbor and all of Michigan
What are the requirements for a divorce?
To file for a divorce in Michigan, the married couple must have resided in the state for at least 180 days prior to filing, and in the county they're filing in for at least ten days.
How long will a divorce take?
The answer to this will depend almost entirely on your individual case. A simple, uncontested divorce with no children involved can be granted as soon as within 60 days of filing (the mandatory waiting period in Michigan). In a marriage with children, the waiting period is 180 days, although it is possible that a judge may waive part of this waiting period in certain cases.
This does not mean, however, that every divorce can be completed this quickly and easily. For a thorough evaluation of your specific case and an estimate of the time it might, call our divorce lawyer today for your personal consultation.
Are there alternatives to divorce?
Yes. In cases in which a couple wants to leave their options open, or in which they cannot get divorced for religious or financial reasons, a separate maintenance order (also called a legal separation) is an alternative.
My partner has filed for a divorce. Can I refuse?
No. In Michigan, a divorce will be granted at the request of only one party, if he or she will attest that the marriage is not salvageable.
