Is there a formula for dividing property during a divorce?
Unlike child support, there is no clear formula for the division of property following a divorce. Decisions about property division are made based on a number of different factors, including how the property was acquired, each party's income and ability to maintain the property in question, and other factors.
Does the parent who gets primary custody always get the house?
No. While it is often the case that the parent with primary custody of the child will be awarded the house so as to minimize the trauma to the child, it is not mandatory.
Will my spouse be awarded any of the property I had before I married him or her?
Not in most cases. One factor in property division is how the property was attained. In most cases, property that you owned before the marriage will be awarded to you in the final settlement.
