Mediation Attorney - Settlement FAQ

Serving Detroit, Ann Arbor and all of Michigan

Why should I agree to mediation?
Mediation is a more casual, less traumatic, and frequently less expensive alternative to a full-blown court case. Settling in mediation can also help you preserve your privacy, whereas in court proceedings, mediation negotiations are not a matter of public record.

Do settlement and mediation mean we don't need to hire lawyers?
In most cases, you should not need a lawyer present during mediation. However, you should consult with an experienced mediation attorney to help you determine ahead of time what your rights and responsibilities are, and what sort of settlement you should expect.

We at Robert G. Morrison & Associates, P.L.L.C. are strong advocates of the mediation process, and recommend that our clients attempt to resolve their issues through mediation whenever possible, to save them the time, money, and frustration of a court trial. If you are considering mediation, call us today to discuss your case.

What is the difference between arbitration and mediation?
Both arbitration and mediation involve having your case heard by a neutral third party, who guides the negotiations. The difference is that arbitration is binding-you are required to follow the orders of the arbitrator, while the mediator has no authority to issue orders.

What if we can't reach an agreement in mediation?
If attempts to resolve your issues through mediation fail, you can take your case to court.
