The division of property during a divorce proceeding can be both contentious and complicated. Ideally, the parties will work out an equitable arrangement to distribute their shared marital property, but all too often, these things cannot be settled as peaceably and as equitably as we would like.

In cases in which the parties cannot come to an agreement about the distribution of their property, the case can be taken to trial, where the court will make final decisions about the property division.

Some of the factors that the court will consider in these cases include:

• When and how the property was acquired—was it acquired during the marriage, or did one party or another bring it to the marriage with them?
• The individual lifestyles and income levels of each party—are both parties capable of reasonably maintaining the property in question, and which party has the greater need for the property?

In a case in which the family home is at issue, for example, the court may have to determine whether both parties would be financially able to maintain the mortgage payments, taxes, and other maintenance on the home. They may also consider other issues, such as which parent will be the primary custodian of any children, and whether awarding the home to the non-custodial parent would unreasonably traumatize or inconvenience the children.
